Terms:

Artists:
Artists are individuals who create and share music projects on the BeMajor platform; backers pledge to support various artist projects in anticipation of receiving rewards.

Collaborators:
These are third parties that artists can engage to assist in managing their music projects. Collaborators may have access to the information available to artists, including backers' names, email addresses, pledge amounts, reward selections, messages, and survey responses. They are required to treat backers' personal information with the same care and respect as artists.

Backers:
Backers are BeMajor's users or third parties who pledge support to help bring music projects to life.

Changes to This Policy

We may update this Policy periodically. If we do, we will inform you about any significant changes, either by notifying you on the BeMajor website (the "Site") or by sending you an email. New versions of this Policy will not apply retroactively, and we will specify the effective date. Your continued use of BeMajor after changes signifies your acceptance of this Policy.

Who We Are

BeMajor ApS (CVR: 44216868), located at Vester Voldgade 96, 1552 København V, Denmark, operates BeMajor and provides services that empower artists to bring their music projects to life. Our primary service is a funding platform for music projects.

How This Policy Applies

This Policy outlines how we collect information from you, how we use that information, and the legal basis for processing it. It also addresses whether and how we may share your information and your rights and choices regarding the information you provide.

This Policy is an integral part of BeMajor's Terms of Use. Definitions of capitalized words are available in our Terms of Use. We use cookies and similar technologies, as explained in our Cookie Policy.

Before using or submitting any information through BeMajor's Services, please carefully review this Policy.

Information We Collect

BeMajor collects information in various ways, including:

  1. When users directly provide information to us (when creating an account).
  2. When we passively collect information from you (e.g., through your browser).
  3. From third parties (e.g., BeMajor's trusted payment provider).

To create a BeMajor account and use our Services, we need to collect and process certain information. Depending on your use of the Services, this may include:

  • Information you provide when completing forms on BeMajor, such as your name, email and postal addresses, telephone number, country of residence, login, and password details. We may request this information when you register as a user, subscribe to our newsletters, complete surveys, submit content to BeMajor, or contact us.
  • Information you provide for identity verification when launching a music project, including your legal name, business name, and Tax ID for business entities, along with your date of birth. In some cases, our payment processor may require you to securely upload an identity document (e.g., passport, driver's license, or government-issued ID) to BeMajor. 
  • Details of any requests or transactions made through the Services. BeMajor partners with other companies (e.g., Stripe) for payment processing, and your payment information is collected and used by them in accordance with their privacy policies (please read Stripe's privacy policy). BeMajor does not store your complete payment information; we retain only the last four digits of your credit card or bank account (if applicable), expiration date, and country for tax, regulatory, and security purposes.
  • Information about your activity on BeMajor, including interactions with our mobile apps (e.g., your IP address, device or browser type, and actions on the Site).
  • Information regarding how users visit and engage with our Site, including traffic analytics provided by tools like Google Analytics, Google Maps, and Meta Pixel. For more information about our use of data analytics to enhance our Services and security, please see our Cookie Policy.
  • Information needed to use Google Maps features and content for tax purposes. Using Google Maps features and content is subject to the current versions of Google Maps/Google Earth Additional Terms of Service at https://maps.google.com/help/terms_maps.html and Google Privacy Policy at https://www.google.com/policies/privacy/.
  • Communications sent to BeMajor (e.g., support inquiries, questions or comments, problem reports).
  • Information submitted on BeMajor's platform, such as comments, contributions to discussions, or messages to other users.
  • Optional demographic data, such as age, gender identity, sexual orientation, race, and ethnicity, which you may choose to provide to help BeMajor support artists equitably and represent a diverse population in our research. This category may include data that qualifies as protected classifications under other California, federal, or other applicable laws. You have the option to decline providing this information.

You can choose not to provide us with certain information, but this may limit your ability to register an account or use our Services. You can review, modify, or delete your information through your account settings.

How We Use Your Information

There are circumstances in which BeMajor may share your information, seeking to share only the minimum necessary data when sharing with third parties. Here are the circumstances in which we may share your information:

  1. Consent: BeMajor may share your information with third parties based on your consent.
  2. Service Providers: We may share your information with third parties who perform services on our behalf, including recruitment, marketing, customer support, legal services, data storage, data analysis, and processing.
  3. Affiliates: We may share your information with current or future affiliated companies, including for business transactions like corporate divestitures, mergers, consolidations, acquisitions, reorganizations, or other asset dispositions. We will also share information with our affiliates in connection with bankruptcy or similar proceedings.
  4. Aggregated or De-identified Information: To personalize your experience, we may share de-identified and/or aggregated data with third parties, including advertisers and promotional partners.

For instance, we use identity, device, and location information to prevent fraud and abuse and to maintain the security of BeMajor and our Services. BeMajor may also send you promotional communications about our Services, subject to your right to control whether we do so.

We analyze user interactions with our Site to better understand what design elements are working effectively and which need improvement, enabling us to enhance the online experience for our users.

Information Shared Publicly

When you create an account on BeMajor, we establish a basic profile page containing your username, account creation date, and a list of projects you have supported or launched. By default, your profile is private, but you can choose to make it public in your account settings. If your profile is public, others can view:

  • Your selected account username and creation date.
  • Any information you add to your profile (e.g., picture, bio, location, website(s)).
  • Projects you have supported (excluding pledge amounts and rewards chosen).
  • Projects you have created.

If you wish to maintain a public profile but do not want others to see your name or profile picture on a project's Community tab, you may select an account image or name that does not identify you (e.g., CatLuvr88). You can modify or delete specific information associated with your account (e.g., username, profile picture, biography, location) from your account settings and adjust privacy settings to make your profile private or change the default settings.

Artists are required to verify their identities before launching a project. Once verified, the artist's Verified Name will be publicly displayed on their account profile and on any projects they create.

When a backer pledges to a project, the artist receives information about the backer, including their name and pledge amount. If the project successfully reaches its funding goal, creators receive limited backer information, such as an email address. This allows creators to send customized surveys to obtain postal addresses for delivering rewards.

Information Not Shared Publicly

Certain data will not be publicly displayed or disclosed to other users:

  • Payment information you provide.
  • Your password details.
  • Your IP address.
  • Your phone number.
  • Your date of birth and other identity verification documents (for artists).
  • Private profile information, as per your preferences.
  • Communications sent to BeMajor (e.g., support inquiries, questions, comments).

Information Shared with Trusted Third-Party Services

We may share your information with trusted third-party services to assist us in providing, improving, promoting, or safeguarding BeMajor's Services. We may also share aggregated and anonymized data that does not directly identify you.

Information Shared with Artists and Collaborators

Artists play a central role in BeMajor's Services as they create the music projects that drive our mission. As such, artists are obligated by this Privacy Policy and should not sell or share personal information except for fulfillment purposes.

Any artist choosing to add a collaborator to a project must do so in a manner that complies with data sharing practices outlined below. Whether a collaborator is an individual or a fulfillment company, they are prohibited from using backer information provided by artists for purposes other than direct fulfillment, such as shipping rewards. BeMajor reserves the right to take disciplinary actions, including suspension, against artists violating these requirements.

Data Sharing Procedures for Artists and Collaborators

When you support a music project, the artist will have access to your username, pledge amount, mailing address for fulfillment, and the reward you have selected. Artists do not receive your credit card details or other payment information.

If a music project you have supported is successfully funded, the artist will receive your email address associated with your BeMajor account. They may also send you a survey to collect information required to fulfill your reward (e.g., mailing address or T-shirt size). Any data you provide in these surveys will be accessible to the artist.

Artists are required to maintain the confidentiality of backer information and share it only as necessary to communicate with backers directly and fulfill rewards. Artists should not request personal information that is unnecessary for reward fulfillment and should never solicit sensitive personal information such as Social Security numbers or payment details. If you receive a request for inappropriate or excessive information, please contact us at support@bemajor.com.

Collaborators are third parties artists can engage to assist in managing their music projects. Collaborators may access information available to artists, including backers' names, email addresses, pledge amounts, reward selections, messages, and survey responses. Collaborators are required to treat backers' personal information with the same care and respect as artists.

Information Shared to Protect BeMajor and Comply with the Law

BeMajor reserves the right to disclose personal information when deemed reasonably necessary to comply with the law or law enforcement, prevent fraud or abuse, or protect BeMajor's legal rights, property, employees, users, or others.

Links to Other Websites and Services

BeMajor's Site may include links to other websites or services with distinct privacy practices. When you use a link to access an external site or service, the privacy policy and data processing disclosures of that site or service apply.

Your Rights

If you are a resident of certain jurisdictions, such as the EU, you have specific rights regarding your personal information. These rights may include the ability to access, correct, and request the deletion of your personal information. While these rights may not apply universally, all BeMajor users can manage their personal information through their account settings. You may also request a downloadable copy of your personal data from BeMajor's account settings page. To modify or delete the personal information you have provided, please log in and update your profile. You may also delete your account from your account settings page. BeMajor may retain certain information as required by law or for legitimate business purposes.

Privacy Rights Disclosure and Request

Certain jurisdictions allow you or an authorized agent to make specific requests regarding your personal information. Depending on local privacy rights, BeMajor offers various options to manage your personal information. Throughout this Policy, we discuss the specific pieces of personal information we collect from and about users. We are also required to provide you with the "categories" of personal information we collect. These categories, along with examples of what we may collect, include:

  1. Identifiers and Contact or Registration Information: e.g., name, date of birth, email address, postal address, telephone number, country of residence, wireless device identifier, account username and password, government-issued ID (e.g., passport, driver's license).
  2. Statistical Information: e.g., marital status, education, professional or employment-related information, interests, lifestyle information, and hobbies.
  3. Commercial and Financial Information: e.g., business name, tax identification numbers, transaction history, the last four digits of credit/debit card numbers, transaction history, and bank account information.
  4. User-Generated Content: e.g., photos, videos, audio, information submitted in public forums or message boards, and feedback or testimonials about our Services.
  5. Customer Service Information: e.g., questions and other messages directed to us through online forms, email, phone, or post, as well as summaries of interactions with the BeMajor Support Team.
  6. Device Information and Device Identifiers: e.g., IP address, browser type and language, operating system, platform type, device type, software and hardware attributes, unique device, advertising, and app identifiers.
  7. Connection and Usage Data: e.g., information about files downloaded, domain names, landing pages, browsing activity, content or ads viewed and clicked, access times, error logs, and similar information.
  8. Information Used to Administer BeMajor's Copyright and DMCA Policy: e.g., any information required to handle DMCA takedown- and counter-notices.
  9. Other Information: e.g., any other information you directly provide in connection with your use of the Services.

Certain laws allow you or an authorized agent to make specific requests regarding your personal information. Where applicable law provides, an agent may request the following on your behalf:

  1. Information about the categories of personal information we collect or disclose about you, the categories of sources of such information, the business or commercial purpose for collecting your personal information, and the categories of third parties with whom we share/disclose personal information. Such information is also set forth in this Policy.
  2. Access to and/or a copy of certain information we hold about you.
  3. Deletion of certain information we have about you.
  4. Correction of inaccurate personal information we have about you.
  5. Information about the financial incentives (e.g., benefits or payments) we offer to you, if any.

Please note that certain information may be exempt from such requests. For example, we need certain information to provide the Services to you. We will also take reasonable steps to verify your identity before responding to a request. You are permitted to designate an authorized agent to submit specific requests on your behalf. To verify that your agent has been authorized to make a request on your behalf, we may require them to provide a signed written authorization or a copy of a power of attorney.

Some jurisdictions impose obligations on businesses that sell or share personal information with third parties.

Limited Use of Sensitive Personal Information

Certain jurisdictions provide the right to know how your sensitive personal information is collected, used, shared, and retained. BeMajor processes this type of sensitive personal information only in specific contexts, such as geolocation, derived from your IP address with your permission according to your mobile device settings, or for other limited purposes required by law and regulations.

BeMajor also conducts optional artist surveys that collect demographic data, including gender identity and sexual orientation, to enhance the artist experience.

How We Use Your Personal Information

We use and share the categories of personal information we collect about you in line with various business purposes discussed throughout this Policy, as described in the "How We Use This Information" and "How This Information Is Shared" sections above.

Several laws impose certain obligations on businesses that "sell" or "share" personal information with third parties. BeMajor does not engage in such activity and has not engaged in it in the past twelve months from the effective date of this Policy. Certain laws also grant you the right to not face discrimination for exercising your privacy rights.

Digital Millennium Copyright Act (DMCA)

In our administration of BeMajor's Copyright and DMCA Policy, we collect information related to takedown- and counter-notices. These notices concern disputed intellectual property matters and come from third parties. BeMajor's policy is to publish these notices on Lumen after removing any personally-identifying information, such as the claimant's name, email, and phone number. The claimant's address and company name are not removed and are publicly posted. By submitting a DMCA takedown-claim or counter-notice, the claimant and counter-claimant consent to the use and sharing of this information in connection with this posting.

Shine the Light

The California "Shine the Light" law gives California residents the right, under certain circumstances, to request information from us about how we share certain categories of personal information (as defined in the Shine the Light law) with third parties for their direct marketing purposes. BeMajor does not share your personal information with third parties for their own direct marketing purposes.

European Union & Denmark Users

The General Data Protection Regulation (GDPR) in the European Union requires a "lawful basis" for collecting and retaining personal information from citizens or residents of the European Economic Area. Since 2018, the UK has its own UK Data Protection Act, closely aligned with the GDPR.

In other words, the lawful basis is the legal foundation BeMajor relies on to use or disclose information directly linked to or usable for your identification. Our lawful bases encompass:

  1. Performing the Contract: In specific circumstances, we require your personal data to fulfill our contractual obligation to deliver the Services, allow artists to establish and showcase their projects, and enable backers to discover and pledge to them.
  2. Legal Compliance: Sometimes, legal requirements necessitate the collection and use of your data. For example, tax laws mandate the retention of records of pledges and payments made through our Services.
  3. Legitimate Interests: This is a term in data protection law denoting that BeMajor has a valid and fair reason to utilize your data. We use your data to pursue our legitimate interests in a manner that might reasonably be expected as part of operating our Services, enhancing them, and ensuring their security.
  4. Consent: When needed, we will collect specific personal information only after receiving your consent. You have the right to withdraw your consent anytime. However, this will not affect any processing that took place before the withdrawal.
